Public Hearing-E. Shady Ln. Reconstruction with Pedestrian Trail

A NOTICE OF PUBLIC HEARING ON SPECIAL ASSESSMENTS WITHIN THE TOWN OF MENASHA, AS LOCATED IN WINNEBAGO COUNTY, STATE OF WISCONSIN.

(RECONSTRUCTION OF EAST SHADY LANE WITH PEDESTRIAN TRAIL PROJECT)

 PLEASE TAKE NOTICE that the Town of Menasha Board of Supervisors, as located in Winnebago County, State of Wisconsin, has declared its intention to exercise its special assessment powers pursuant to Chapter 60 and Section 66.0703 of the WI Statutes to levy special assessments upon property within the following described area for improvements upon said property.

Work shall consist of the reconstruction of East Shady Lane, from Cold Spring Road to American Drive, with installation of curb & gutter, storm sewer main, storm sewer laterals, and a ten (10) foot asphalt pedestrian trail to be installed on the south side of the road.

Said improvements shall include the required cost of construction and installation, including contract costs, engineering fees, attorney fees and publication expenses of the municipality.

 The Town Board of Supervisors shall hereby determine that all such municipal improvements shall be made under Chapter 60 and Section 66.0703 of the WI Statutes and that the amount to be assessed against each affected parcel is based upon a reasonable basis being total construction and material cost including engineering fees, attorney fees, publication expenses and other appropriated special assessment proceeding costs.  The Town Board of Supervisors further determines that all said improvements specially benefit the property described in Paragraph 1 above.

 The assessments against affected property owner(s) may be paid in full or in the number of installments to be determined at the public hearing on the proposed assessments and according to the final resolution of the Town Board of Supervisors of the Town of Menasha as may be hereinafter adopted.

The Town Engineers are directed to prepare an Engineer’s Report consisting of:

a)    Preliminary estimates for the entire cost of the proposed construction and installation, including cost of construction, material, engineering fees, attorney fees, publication expenses and other appropriate cost of special assessment proceedings.

b)    A schedule of proposed assessments against affected property prepared under the terms and conditions of Chapter 60 and Section 66.0703 of the WI Statutes.

c)    The Engineer’s Report shall state that all such assessments are based upon a reasonable basis being total construction and material costs and that all said special assessments benefit the property(ies) being assessed.

Upon completing said Engineer’s Report the Town Engineers are directed to file a copy of the same in the office of the Town Clerk for public inspection.

 YOU ARE FURTHER NOTIFIED that the Town Board of Supervisors for the Town of Menasha will hear all persons interested, or their agents or attorneys, concerning matters contained in the preliminary assessments and the Report of Engineers at a Public Hearing to be held in the Arden Tews Assembly Room at the Town of Menasha Municipal Complex, 2000 Municipal Drive, Neenah, WI, 54956, Winnebago County, State of WI, on the 28th day of April, 2014 at 6:00 p.m. or soon thereafter, during the regularly scheduled Town Board Meeting.

 All objections will be considered at said hearing, and thereafter, the amount of the assessments shall be determined by the Town Board of Supervisors pursuant to any final resolution levying special assessments as voted upon and passed at any subsequent regular or special meeting of the Town Board of Supervisors.
