The minutes of September were
reviewed. Motion by
Chairperson Bellmer, seconded by Commissioner Sabel to approve the minutes of
the
COST BENEFIT ANALYSIS

The cost-benefit
table for September shows that there is a positive cost-benefit for the month
and year.
NEW ITEMS OF BUSINESS:
Department of Community Development Director George Dearborn introduced
the item.
MOTION: Chairperson Bellmer, seconded
by Commissioner Jochman to approve the Sign.
Commissioner Schaetz asked if the lighting shines up or down on the sign.
Associate Planner Mommaerts stated that no additional information was
provided.
MOTION: Chairperson
Bellmer, seconded by Commissioner Jochman to add a condition that the flood
lighting only lights the sign.
Motions carried 6-0-1
(Commissioner Van Dyke).
Department of Community Development Director George Dearborn introduced
the item.
Chairperson Bellmer asked if the original approval for the second
building was a mirror image of the first building.
Director
Commissioner Schaetz asked if the stormwater requirements are met.
Director Dearborn stated that it was approved by the Town Engineer.
MOTION: Chairperson
Bellmer, seconded by Commissioner Buck to approve the Conditional Use Permit
Modification with the following conditions:

All other
conditions of the original Conditional Use Permit shall apply.
·
A detailed Site
Plan Review shall be completed by Town Staff.
Motion carried 6-0-1

Department of Community Development Director George Dearborn introduced
the item.
Commissioner Jochman stated that the focus of the development is inside
the horseshoe off of
Kelly Claflin, of Portside Builders, stated that the split is for resale
purposes and to make it cleaner. The issue
is the street right-of-way and the setbacks.
The company would pursue a variance or a condominium plat if they cant
make the setbacks work.
Chairperson Bellmer asked what the setback are.
Associate Planner Mommaerts responded that the street yard setback is
30-feet, the rear setback is 25-feet and the side yard setback is 10-feet for
one side and 7-feet for the other.
Commissioner Koeppe stated that the worst case scenario is that the Town
approves the CSM as is and the County denies it as it doesnt meet the
setbacks.

MOTION: Commissioner
Jochman, seconded by Commissioner Sabel to approve the Certified Survey Map with the
following conditions:

All taxes and assessments shall be paid prior to the
Town affixing signatures on the Certified Survey Map.
·
All buildings
shall meet the setbacks of the Winnebago County Town/County Zoning Code.
Motion carried 6-0-1
(Commissioner Van Dyke).
Department of Community Development Director George Dearborn introduced
the item.
Commissioner Jochman stated that the faηade appears acceptable.
Chairperson Bellmer stated that the arch is not as dominant as envisioned.
MOTION: Commissioner
Jochman, seconded by Commissioner Schaetz to approve the B-5 Conditional Use
Permit Modification to eliminate the previous condition that a matching arch
over the eastern tenant space be eliminated.
Motion carried 6-0-1 (Commissioner Van Dyke).
Department of Community Development Director George Dearborn introduced
the item and stated the ordinance should not discourage wind energy systems on residential
parcels.
Chairperson Bellmer stated that some model ordinances seem too
restrictive.
Commissioner Schaetz stated that aesthetics and view corridors are an
issue. She also asked if road
reconstruction should be included and whether the setback exception for
structures under 75 was appropriate.
Commissioner Buck also stated the setback exception as a concern.
MOTION: Commissioner
Schaetz, seconded by Commissioner Buck to delay for 60-days the Wind Energy
System Ordinance so that more information can be collected. Motion carried 6-0-1 (Commissioner Van Dyke).
OLD ITEMS OF BUSINESS:
Department of Community Development Director George Dearborn introduced
the item.
MOTION: Commissioner Jochman, seconded by Chairperson Bellmer to approve the Certified Survey Map with the following conditions:

All taxes and assessments shall be paid
prior to the Town affixing signatures on the Certified
